Purpose

When you grant someone power of attorney over your interests, that person can do anything with your property that you can. When your agent does something with your property in your name, its the same as if you did it yourself. A durable power of attorney allows your agent to manage your property even after you become disabled.

Parties

You – As the principal of this document, you are authorizing your agent to act in your name.

Agent (Attorney in Fact) – The person you authorize to act in your name is your agent or “attorney in fact”.

Attributes

Complexity: 2/10 – The form of the document itself is established by Texas statute, so it isn’t very complicated. You and your agent should be aware, however, of the duties an agent owes to the principal.

Privacy : 10/10 – This document does not become public record.

Control: 3/10 – Granting a power of attorney gives your agent authority to act on your behalf. While the power can be limited to very specific issues and even to specific transactions, it should only be granted to someone you trust to manage your property.
